If I create a revocable living trust, do I still need a will?
It is very important that if you create a revocable trust that you definitely have a will as a substitute for any assets which you forgot to, or which you purchased or obtained after creating the trust. A lot of people purchase a new home, new cars, open up a new bank account after they actually create a revocable trust, and forget or fail to add those assets to the trust. Therefore, they have to then go through probate. The will is what’s called a poor over will, adds all of the assets from your estate back into the trust if you fail to add them.
